In no event shall PixieDust AI's aggregate liability exceed the greater of one hundred dollars ($100) or the amount you paid PixieDust AI, if any, in the past six months for the Services giving rise to the claim.

You agree to defend, indemnify, and hold harmless PixieDust AI and its licensors, suppliers, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of or in connection with your use of the Services or violation of these Terms.

12. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PIXIEDUST AI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in Delaware, and the arbitrator's decision shall be binding and may be entered as a judgement in any court of competent jurisdiction.

You and PixieDust AI agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both you and PixieDust AI waive any right to a jury trial.

14. Waiver of Class Actions

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND PIXIEDUST AI EACH WAIVE THE RIGHT TO BRING ANY DISPUTE AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS OR REPRESENTATIVE ACTION. Unless both you and PixieDust AI agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims and may not otherwise preside over any form of a consolidated, representative, or class proceeding.
